Unfortunately, it is all too common for a contractor to tell us that he or she makes $100,000 after spending during the year, and then during the preparation of the tax, he or she tells us about a $20,000 refund. It creates a big refund, of course, but it is not good tax planning. Employees, including contractors/employees, are often forced to pay expenses on behalf of their employer or business. In most cases, they do so either in the hope of being reimbursed or until the end of 2017, pending the claim of expenses as another individual deduction (beyond a threshold of 2% of Adjusted Gross Income (AGI). If employers reimburse expenses, workers may have to include the amount in the form of taxable compensation, but would generally prefer a tax-free refund, particularly if they do not have a net benefit. You can do this — and the company can continue to claim a deduction for expenses — if your employer reimburses them through a responsible plan. If an employer has a plan to make but incorrectly reports expense reimbursements to an employee on its W-2 form, the employee must request a corrected W-2.

The liability plan must also include a procedure requiring workers to return excess refunds (which go beyond the authorized amounts) to the employer. When an employer establishes and maintains a responsible plan, workers` travel expenses should not be considered taxable income. A responsible plan is an employee compensation plan or a method of reimbursement of operating expenses in accordance with IRS rules.
